Privacy policy
How AV Landscape Pty Ltd collects, uses, stores and discloses personal information, and what you can do about it.
1. Who we are
This policy is issued by AV Landscape Pty Ltd (ABN 88 700 032 908, ACN 700 032 908), a company registered in Western Australia and operating the website avlandscapetec.site. In this policy, “we”, “us” and “our” mean AV Landscape Pty Ltd.
We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) contained in that Act. This policy explains what we collect, why we collect it, who we give it to, and how you can access or correct it.
2. What personal information we collect
We only collect personal information that we reasonably need in order to quote for, plan and carry out landscaping work. Depending on how you deal with us, that may include:
- Your name and the name of any organisation you represent
- Your email address and any phone number you choose to give us
- The address, suburb and postcode of the property where work is proposed
- Details about the site and the work you want done, including notes, measurements, levels and any plans or photographs you send us
- Records of our correspondence with you, including quotes, variations and invoices
- Billing and payment records, such as the reference and date of a payment made to us
We do not seek sensitive information as defined in the Privacy Act, and we ask that you do not send it to us. We do not collect government identifiers such as tax file numbers from our clients.
3. How we collect it
We collect personal information directly from you wherever it is reasonable and practicable to do so — when you email us, when you complete the enquiry form on our contact page, when we visit your property, and in the course of carrying out work.
In some cases we may collect information about a property from a third party, such as a builder, architect, strata manager, property manager or a person who has referred you to us. If we collect your personal information from someone else, we will take reasonable steps to make you aware of that collection and of this policy.
4. Why we collect and use it
We use personal information for the purposes for which it was collected and for directly related purposes you would reasonably expect, including to:
- Respond to your enquiry and arrange a site visit
- Prepare a design, a site plan, a scope of work and a quotation
- Carry out, supervise and schedule the work agreed with you
- Order materials and coordinate contractors and suppliers for your project
- Invoice you, take payment and keep the financial and tax records we are required by law to keep
- Deal with warranty questions, defects, complaints or disputes
If you do not give us the information we ask for, we may not be able to quote accurately or to carry out the work.
5. Who we disclose it to
We do not sell personal information, and we do not disclose it for any purpose unrelated to your project. We may disclose personal information to:
- Subcontractors and tradespeople engaged on your project, such as excavation, retaining, paving, irrigation, electrical or arboricultural specialists
- Suppliers, where a delivery address or site contact is needed
- Our accountant, bookkeeper, insurer or professional advisers
- Providers of the technology services we use, such as email and website hosting
- A government agency, regulator or court where we are required or authorised by law to do so
Where we engage a third party, we take reasonable steps to require them to use the information only for the purpose we gave it to them.
6. This website, cookies and analytics
This website is a set of static pages. It does not set cookies, it does not run analytics or advertising scripts, it does not load fonts, images or scripts from third-party servers, and it does not build a profile of you.
The enquiry form on our contact page does not send data to a server of ours. It opens a message in your own email program, addressed to [email protected], which you choose whether to send. You can email us at that address directly instead.
Our hosting and email providers may keep standard technical logs, which can include IP addresses, in order to deliver the site and our mail and to protect against abuse. We do not use those logs for marketing.
7. Overseas disclosure
Our website hosting and email routing are provided by service providers that operate internationally, so information you send us may be stored on, or transmitted through, servers located outside Australia. Before disclosing personal information to an overseas recipient, we take reasonable steps to ensure it is handled consistently with the Australian Privacy Principles.
8. Storage, security and retention
We hold personal information in electronic form, and occasionally in hard copy where a plan or a signed document is involved. We take reasonable steps to protect it from misuse, interference and loss, and from unauthorised access, modification or disclosure — including access controls on the accounts we use and restricting information to the people who need it for your project.
We keep project and financial records for as long as we need them for the purposes described above, and for as long as we are required to keep them under Australian tax, corporations and limitation-of-actions law. When information is no longer needed and we are not required to retain it, we take reasonable steps to destroy it or to de-identify it.
If a data breach occurs that is likely to result in serious harm, we will respond in accordance with the Notifiable Data Breaches scheme under the Privacy Act 1988 (Cth).
9. Accessing and correcting your information
You can ask us for access to the personal information we hold about you, and you can ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading. Email your request to [email protected].
We will need to be reasonably satisfied of your identity before we release information. We will respond within a reasonable period. Access is free, although we may charge for the reasonable cost of collating or copying a large volume of material, and we will tell you before we do. If we refuse access or refuse to make a correction, we will explain why in writing and tell you how to complain.
10. Direct marketing
We do not run marketing campaigns and we do not add enquiry contacts to a mailing list. If we ever send you material about our services, it will be related to work we have done for you and it will include a simple way to opt out. You can tell us at any time that you do not want to receive it, by emailing [email protected].
11. Anonymity
You may ask a general question about our services without identifying yourself. However, we cannot prepare a quotation, attend a site or enter into a contract without knowing who you are and where the property is.
12. Complaints
If you think we have breached the Australian Privacy Principles or mishandled your personal information, please tell us first. Email the details to [email protected] with “Privacy complaint” in the subject line. We will acknowledge your complaint, investigate it and give you a written response within a reasonable period, usually within 30 days.
If you are not satisfied with our response, you may refer the matter to the Office of the Australian Information Commissioner (OAIC), which can investigate privacy complaints about Australian organisations.
13. Changes to this policy
We may update this policy from time to time to reflect changes in how we operate or in the law. The current version is always the one published on this page, and the date at the top of the page shows when it was last revised.
